URGENT INVESTIGATION NEEDED IN THE CASE OF TORTURE AND INHUMAN TREATMENT OF A MINOR IN KAMZA!

CRCA/ECPAT Albania:Torture against any human being is unacceptable and illegal, but when it is exercised against a child it shows that the Police Authority is far from respecting and protecting the rights of the child!

Tirana, March 31, 2021- National Centre for Rehabilitation and Reintegration of Juveniles in Conflict with the Law and CRCA / ECPAT Albania, through this statement address the State Police and the Commissioner for Protection and Promotion of Children's Rights at the Ombudsman Albania, for requested their intervention in institutional investigations regarding the violence against the juvenile DB, 16 years old, in the area of ​​Kamza.

On March 29, 2021, at 08:00, the juvenile DB was escorted by the police patrol from his house to the Police Station no. 5, in Kamza, in order to be interrogated in connection with a theft committed one day ago. seen in the Kamza area. During the escort moment, the juvenile D.B was escorted to the premises of Commissariat no. 5 by his mother, thanks to the latter's insistence not to leave the boy alone.

At the moment that DB and his mother arrived at the Commissariats, the latter called the CRCA / ECPAT Albania Office for free legal protection, asking the Police not to interview the juvenile without the presence of the CRCA Lawyer and Psychologist / ECPAT Albania. Meanwhile, one of the police officers saw the lady talking on the phone, and immediately took her phone, not allowing her to stay inside the premises of Commissariat no.5.

The mother of the juvenile waited 6 hours outside the police station and when DB was released, she noticed severe signs of violence such as: damage to one ear, damage to the inside of the mouth, hematoma and bruising on the face and head . The psycho-emotional state of the juvenile is extremely aggravated as a result of torture and inhuman treatment.

CRCA / ECPAT Albania based on the statements it has received so far notes that there are serious violations of the Constitution of Albania, the Code of Juvenile Justice, the Code of Criminal Procedure and other legal acts for the procedure of interviewing juveniles. Based on this serious event, CRCA / ECPAT Albania requests from the State Police and the Commissioner for Protection and Promotion of Children's Rights to the Ombudsman Albania immediate and independent investigation of the case of torture and inhuman treatment of 16 year old DB and prosecution criminal charges against any police officer in Commissariat no.5 who have ill-treated a minor.
